  5. The Seller is the controller of personal data processed in connection with the operation of the Store. Detailed information about data processing, cookies and the rights of data subjects is provided in the Privacy Policy available in the Store.

  1. Business day — a day from Monday to Friday, excluding public holidays.
  2. Customer — a natural person, legal person or organisational entity with legal capacity that uses the Store or enters into a sales contract with the Seller.
  3. Consumer — a natural person entering into a legal transaction with the Seller that is not directly related to their business or professional activity.
  4. Sole trader with consumer rights — a natural person entering into a contract directly related to their business activity where the content of the contract shows that it is not of a professional nature for that person.
  5. Product — a movable item offered in the Store, in particular jewellery.
  6. Order — a declaration submitted by the Customer through the order form, aimed directly at entering into a sales contract.
  7. Electronic service — a service provided electronically through the Store, in particular a customer account, order form and newsletter.

3. Electronic services

  1. The Seller provides an order form, customer account and newsletter free of charge.
  2. Shopify customer accounts are passwordless. To sign in, the Customer enters an email address and uses the one-time login code sent to that address. The Customer may ask the Seller to delete their account.
  3. Use of the order form begins when a Product is added to the cart and ends when the Order is placed or the checkout process is abandoned earlier.
  4. Customers subscribe to the newsletter by voluntarily entering an email address in the subscription form or selecting the relevant consent option. Where double opt-in is used, the subscription is activated after the link in the confirmation email is clicked. Customers may unsubscribe at any time using the unsubscribe link in a message or by contacting the Seller.
  5. Using the Store requires a device with Internet access, an up-to-date web browser and, for functions requiring communication, an active email address.
  6. The Customer must use the Store in accordance with the law and accepted standards of conduct, provide accurate information and refrain from submitting unlawful content.
  7. Complaints about the operation of electronic services may be sent to info@maugojewelry.com. The Seller will respond without undue delay, no later than 14 days after receiving the complaint.

4. Placing orders and entering into a contract

  1. Product information in the Store constitutes an invitation to enter into a contract.
  2. The Customer places an Order by selecting a Product, variant and quantity, adding it to the cart, entering the details required at checkout, selecting an available delivery and payment method, and using the button that finalises the Order.
  3. Before placing an Order, the Customer is informed of the main characteristics of the Product, the total price including taxes, delivery costs and other charges, and can check and correct the information entered.
  4. After an Order is placed, the Seller sends confirmation of its receipt and acceptance for fulfilment to the email address provided. The sales contract is concluded when the Customer receives the message confirming that the Order has been accepted for fulfilment.
  5. The contract is recorded by making these Terms & Conditions available in the Store and sending the Customer an Order confirmation on a durable medium.
  6. The Seller may contact the Customer if fulfilling the Order requires clarification of personalisation, size, timing or other important details.

5. Prices and payments

  1. Prices displayed in the Store are gross prices and include applicable taxes. The currency is shown with the Product and at checkout.
  2. The total price of the Products, delivery cost and any other charges are displayed before the Order is placed.
  3. Available payment methods are displayed at checkout. Payments may be processed by third-party payment providers identified during the purchasing process.
  4. For a payment method requiring immediate confirmation, the Order may be sent for fulfilment once the Seller receives payment confirmation. If the selected method specifies a different payment deadline, that deadline applies.
  5. The Seller issues a sales document in the form required by law; this may be an electronic receipt sent to the Customer's email address.

6. Delivery and fulfilment

  1. Products are delivered to the areas and by the methods available at checkout. The binding delivery cost is always displayed before the Order is placed.
  2. The standard Order preparation time is usually 2–7 Business days. For made-to-order or personalised Products, it may be 4–6 weeks, unless the Product description or individual arrangements state otherwise.
  3. The transit time stated for the selected delivery method must be added to the Order preparation time. Times are estimates unless expressly stated otherwise.
  4. If, for reasons beyond the Seller's control, the Order cannot be fulfilled within the stated time, the Seller will inform the Customer without undue delay and provide a new estimated date or propose another solution in accordance with the law.
  5. Further details can be found in the Shipping Policy.

7. Conformity of goods with the contract and complaints

  1. The Seller must provide the Consumer with a Product that conforms to the contract and is liable for any lack of conformity under the rules set out in the Polish Consumer Rights Act.
  2. In the event of a lack of conformity, the Consumer may request repair or replacement. In circumstances provided for by law, the Consumer may also request a price reduction or withdraw from the contract.
  3. Complaints may be submitted by email to info@maugojewelry.com or in writing to: MAUGO MAŁGORZATA PAWLIK, ul. Na Wzgórzu 22, 80-296 Gdańsk.
  4. To help us handle a complaint efficiently, please provide the Order number, a description of the lack of conformity, the date it was discovered, the Customer's requested remedy and contact details. Failure to provide this information does not deprive the Consumer of their statutory rights.
  5. The Seller will respond to the Consumer's complaint within 14 days of receiving it.
  6. The Seller bears the costs of repair or replacement, including shipping, labour and materials, to the extent required by law.
  7. The provisions of this section concerning Consumers also apply to Sole traders with consumer rights to the extent provided for by applicable law.

8. Right of withdrawal

  1. A Consumer who has entered into a distance contract may withdraw from it without giving a reason within 14 days of the Product being received by the Consumer or a third party designated by them, other than the carrier. Where multiple Products are delivered separately, the period is calculated in accordance with the Polish Consumer Rights Act.
  2. A notice of withdrawal may be sent to contact@maugojewelry.com or to the Seller's correspondence address. Sending the notice before the deadline expires is sufficient to meet the deadline. The Consumer may use the statutory model withdrawal form, but this is not mandatory.
  3. The Consumer must return the Product to: MAUGO MAŁGORZATA PAWLIK, ul. Na Wzgórzu 22, 80-296 Gdańsk, no later than 14 days after notifying the Seller of withdrawal.
  4. The Consumer bears the direct cost of return shipping. Cash-on-delivery parcels are not accepted.
  5. The Seller refunds payments received, including the cost of the least expensive standard delivery method offered for the Order, no later than 14 days after receiving the withdrawal notice. The Seller may withhold the refund until the Product is received or proof of its return is provided, whichever occurs first.
  6. The refund is made using the same payment method used by the Consumer, unless the Consumer expressly agrees to another method that incurs no cost.
  7. The Consumer is liable for any reduction in the Product's value resulting from use beyond what is necessary to establish its nature, characteristics and functioning.
  8. The right of withdrawal does not apply, in particular, to non-prefabricated Products made to the Consumer's specifications or clearly personalised to meet their individual needs. This includes engraved jewellery, bespoke designs and non-standard lengths, sizes or other parameters made at the Customer's express request. The fact that a standard Product is handmade does not, by itself, exclude the right of withdrawal.
  9. The provisions of this section also apply to Sole traders with consumer rights to the extent provided for by applicable law.

9. Commercial warranty and repairs

  1. In addition to the Seller's statutory liability for the conformity of goods with the contract, MAUGO Products are covered by a 12-month commercial warranty from the date the Customer receives the Product.
  2. The warranty covers manufacturing defects in the jewellery. It does not cover mechanical damage caused by improper use, normal wear and tear, or damage connected with repairs or alterations carried out outside the MAUGO workshop.
  3. The warranty does not exclude, limit or suspend the Consumer's rights arising from a lack of conformity of the goods with the contract.
  4. Warranty claims or enquiries about paid repairs may be sent to contact@maugojewelry.com, including the Order number, a description of the problem and, if possible, photographs of the Product.

10. Out-of-court dispute resolution

  1. After the complaints procedure has been exhausted, the Consumer may use out-of-court methods of resolving consumer disputes. Information about available procedures and authorised bodies is available on the website of the Polish Office of Competition and Consumer Protection: https://polubowne.uokik.gov.pl/.
  2. The Consumer may also seek assistance from a municipal or district consumer ombudsman or the Trade Inspection Authority.
  3. The EU ODR platform was discontinued on 20 July 2025 and is not listed as a channel for submitting complaints.

11. Provisions for business customers

  1. This section applies exclusively to Customers who are businesses and to whom the provisions protecting Consumers or Sole traders with consumer rights do not apply.
  2. To the extent permitted by law, the Seller's liability under the statutory warranty for defects towards such a business customer is excluded.
  3. The Seller may limit the available payment methods or require advance payment where justified by the circumstances of the Order.
  4. The Seller's liability towards a business customer is limited to actual losses foreseeable when the contract was concluded, up to the price of the Order including delivery costs. To the extent permitted by law, the Seller is not liable for lost profits.
  5. Disputes with a business customer will be heard by the court with territorial jurisdiction over the Seller's registered office, unless mandatory provisions of law provide otherwise.

12. Final provisions

  1. Contracts concluded through the Store are entered into in Polish.
  2. The Seller may amend these Terms & Conditions for important reasons, in particular changes in legislation, Store functionality, payment methods or delivery methods. Amendments do not affect acquired rights or contracts concluded before the amendments take effect.
  3. Matters not covered by these Terms & Conditions are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on the Provision of Electronic Services.
  4. The choice of Polish law does not deprive the Consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.
